OF DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 108/MPP/Kep/5/1996
ON STANDARDIZATION, CERTIFICATION, ACCREDITATION AND CONTROL OF
PRODUCT QUALITY WITHIN THE MINISTRY OF INDUSTRY AND TRADE

MINISTER OF INDUSTRY AND TRADE,

Considering :

• a. that to guarantee the quality of export products in the framework of boosting the competitiveness and protection of consumers and workers in terms of safety, health and environment and to facilitate testing laboratory services, it is deemed necessary to affirm the status of a testing laboratory issuing a quality compliance certificate (SM/ for export purposes;
• b. that to this end it is necessary to issue a decree of the Minister of Industry and Trade.

In view of :

• 1. Presidential Decree No. 13/1997 on the National Standardization Agency;
• 2. Presidential Decree No. 61/1998 on the position, tasks, organizational structure and working procedure of ministries;
• 3. Presidential Decree No. 122/M/1998 on the establishment of Development Reform Cabinet;
• 4. Decree of the Minister of Industry and Trade No. 108/MPP/Kep/5/1996 on standardization, certification, accreditation and control of product quality within the Ministry of Industry and Trade.

DECIDES :

To stipulate:

A DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE AMENDMENT TO DECREE OF THE MINIS.TER OF INDUSTRY AND TRADE NO. 108/MPP/Kep/5/1996 ON STANDARDIZATION, CERTIFICATION, ACCREDITATION AND CONTROL OF QUALITY WITHIN THE MINISTRY OF INDUSTRY AND TRADE

Article 1

(1) To amend Article 23 of Decree of the Minister of Industry and Trade No. 108/MPP/Kep/5/1996 on standardization, certification, accreditation and control of product quality within the Ministry of Industry and Trade as follows:

" Article 23

(1) Control over the quality of export products as meant in Article 5 shall be conducted through certification in the form of SM as meant in Article 22 and shall be conducted against lots of goods ready for export prior to shipping by means of having the sample taken by a Sample-Collecting Officer tested at a testing laboratory.

(2) The provision on the procedure of certification in the form of SM as meant in paragraph (1) shall be regulated further by the Secretary General of the Ministry of Industry and Trade."

" Article 23

(1) Prior to shipping, lots of goods ready for export shall be subjected to control over the quality of export products as meant in Article 5 and undertaken through certification in the form of SM as meant in Article 22 by means of having the sample taken by a Sample-Collecting Officer tested at a testing laboratory.

(2) The testing laboratory as meant in paragraph (1) shall be one already accredited by the National Accreditation Committee in accordance with the scope of accreditation obtained and shall be obligated to comply with the provi.sions on and procedure for compulsory quality control for selected export products prevailing within the Ministry of Industry and Trade.

(3) The provisions on and procedure for compulsory quality control for selected export products as meant in sub-arti.cle (2) shall be regulated further by the Secretary General of the Ministry of Industry and Trade. "

(2) With the stipulation of this decree, all other provisions contained in Decree of the Minister of Industry and Trade No. 108/MPP/Kep/5/1996 on standardization, certification, accreditation and control of product quality within the Ministry of Industry and Trade shall remain valid.

Article 2

This decree shall take effect as from the date of stipulation.
